Kathy's Korner Seacrest Estate Update

Received a reply today from Dawn Thomas, acting head of the planning department, about the tree clearing. Here it is:


Hi Kathy - The activity that was permitted was tree cutting, not clearing. The reason this was permitted is because the DEC had issued a letter allowing tree cutting to avoid the new Long Eared Bat regulations - which preclude clearing during certain months of the year (3/1-11/30). Because the developer was wrapping up the final approvals, we allowed them to cut the trees, not remove the stumps or otherwise clear the property. Other than the tree cutting, there was no ground disturbance permitted. Our initial review shows that no trees were cut in the buffer area. Further review for compliance will take place as the project moves forward.

Dawn, Thank you very much for your reply. Much appreciated. I'm afraid I don't fully understand all the nuances of language in the world of construction. When one looks at the property it sure appears to be cleared, but I understand what you are saying: trees were decimated but no ground was disturbed. So a tree cutting permit is distinct from a land clearing permit? As the shape of a roadway can be seen on the property, I don't quite agree that the section of the resolution that I cited in my email to you has not been violated. We thank you for continued vigilance to make sure the open space buffer zone remains undisturbed. If our vigilant neighbors discover that any cutting has been performed in that buffer, we shall certainly let you know. Thanks for your reply. Kathy
